The general conditions apply to all products and services by CAPICUA. .
All data (layout, text, images, ...) available on the website is protected by copyright, trademark law, the law on software programs and/or the database law. The data may not be used, reproduced or made public without prior written permission from CAPICUA or the relevant licensee.
CAPICUA may at any time suspend the access to the website for any time for technical or other reasons, including maintenance of the website or parts of it. This interruption is accepted by the user and the user therefore waives any claim for damages in this regard.
Use of the website brings the knowledge and acceptance of the characteristics, limitations and risks of using the internet and the transmission of data over the internet with it.
The Belgian law is exclusively applicable to the terms and conditions of CAPICUA.
Only Belgian courts have jurisdiction with regard to the terms and conditions.
Only the courts of the juridicial district of Kortrijk are competent to take cognizance of disputes relating to the website of CAPICUA. Only if provided by law this may be dispensed.
The consumer has the right to notify the company that he abandons the purchase without penalty and without giving any reason, within fourteen calendar days from the day following the delivery of the good or the conclusion of the service agreement.
2. Placing an order
All products available via the website.
Promotions are only valid for individuals and only while stocks last.
Discounts apply only on the price of the products and not on any additional costs.
Orders that do not meet the terms and conditions will not be executed. You will be informed by e-mail about this.
The price of a product is presented in euros, inclusive all taxes that are applicable in Belgium.
All prices are given with the utmost care, but material errors are always possible. The prices are subject to material errors or incorrect price input.
Payment can only be made by bank transfer or online payment. Purchased products must be paid within 24 hours. If the payment or the payment confirmation has not been received after three days, the order shall be considered as canceled. If the payment reaches us after this period, the amount will be refunded.

Online orders will be shipped within 2 business days after payment has reached us. CAPICUA uses the services of Bpost (http://www.bpost.be).
Shipping is free in Belgium on orders above the amount of 100€.
The order will be delivered at the delivery address.

All orders received before 3 pm will be dispatched same day.

5. Withdrawal and exchange right
The consumer has the right to inform the company that he abandons the purchase without penalty and without giving any reason within 14 calendar days from the day following the delivery of the good or the conclusion of the service agreement.
For the remote purchase of
- perishable products such as food,
- products with a personal touch,
- audio recordings, video recordings and software that you have opened or have unsealed the package;
there is next aberrant right of withdrawal:
The consumer does not have the right to cancel the purchase.
When making use of the right of withdrawal, you can bring the purchased goods to the CAPICUA's stockroom in Olen (send me an email) or return them. The costs of returning are paid by the customer.
If you return the canceled products, you must add the following documents along with the products:
- the confirmation e-mail that is sent when paying the products,
- the order form,
- specify that you revoke the order of the returned products.
A product that is incomplete, damaged, corrupted, consumed, not in the original packaging or in damaged packaging that will be returned is considered non-compliant and will therefore not be reimbursed.
Products can only be exchanged in the CAPICUA's stockroom, maximum 14 days after the confirmation e-mail was sent. A product that is incomplete, damaged, corrupted, consumed, is not returned in the original packaging or in damaged packaging is considered as non-compliant and can therefore not be exchanged.
CAPICUA is not liable for non-compliance with its obligations in the event of unforeseeable circumstances or force majeure.
The liability of CAPICUA is limited solely to any direct damages, and in no case to any indirect damage, such as commercial loss, loss of data, defects or any other type of indirect damage that was not foreseeable at the time you consulted the website or placed an order.
CAPICUA can also not be held liable for:
- the content or presentation of the product photos,
- the content that contain third-party websites, after following a link on the website,
- damages linked to the use of the internet (interruption, virus, ...).
In accordance with the Law of September 21, 2004 on the protection of consumers in consumer sales, the Customer has a legal guarantee for any lack of conformity of goods, consisting in the delivery of the goods, and manifests itself within two years, starting from the delivery. Articles 1649bis t.e.m. 1649octies Civil Code are applicable.
CAPICUA delivers this commitment. The guarantee applies only on Belgian territory.
The guarantee does not apply if the defect was caused by inattention, damage or non-conforming usage of the product. CAPICUA checks all products before they are shipped.
To replace or examine your product during the warranty period, it should be brought to CAPICUA. After examining the product, it can be replaced or refunded. Any additional costs are not reimbursed.
